Subject: Mandatory Commercial Recycling for Pomona Businesses
Pursuant to State law (AB 341), businesses in California are required to have recycling programs in full operation, as of July 2012. However, not all recycling programs will be the same. For example, if your business produces paper products and your waste is left-over paper, paper will be the only material you would have to recycle.
The purpose of the new law is to preserve our nearby landfill space. New landfills are extremely difficult to site near cities. A large landfill with 100 years of capacity has been sited 200 miles from Pomona but transporting waste to that landfill will cause tremendous increases in trash fees. Recycling is the cheaper alternative.
Is anyone exempt? Yes. Residents who have green containers for greenwaste and blue containers for mixed recyclables are already in compliance with the law and are therefore categorically exempt. Businesses that pay for one (1), 3-cubic yard dumpster that is emptied only once per week, are also exempt from the law. However, all businesses with four (4), cubic yards or more of trash service per week must have a recycling program in place by July 2012.

Cost? The cost of the recycling program will be determined by your waste hauler and the special character of your business. For example, if your business bales and recycles cardboard, you may not need to do anything else and your cost would be the same. If your waste hauler determines that you could benefit from such a system, you may find that recycling could generate a modest amount of revenue. For some businesses, however, there will be a need for a separate recycling bin and a modest increase in the monthly fee for the hauling. Discuss with your hauler if the sale of recyclables can offset some of the hauling cost.
